8th January
I was browsing the sgcarmart.com.sg for a daihatsu copen. I saw one which was quite presentable and reasonable price at PM Motoring , 15 Commonwealth Lane, Lot 47. On the 8th Jan 2011( Sat ), i went down to view the car and my girlfriend liked the car. We were told it was selling at $57800. We didnt get to test drive as we wanted to view another copen in ubi. After talking to the salesman Jimmy, he took down my number and said that he will refer my offer of $55000 to his boss Freddie Khng.
Later in the evening, Freddie called regarding the car and agreed to sell me at $55000. So i agreed to purchase and he told me that he will come to my house for me to sign the sales agreement and loan request form.
9th January
The next day, he came down and i sign a few forms. He asked me to put a deposit of $1500. Since i didnt have have enough cash, i ask him to fetch my girlfriend to the nearby atm to withdraw cash. My girlfriend realised he had written $56000 on the sales agreement instead of $55000 and asked him why is that so. He called me and gave me an excuse “ Sorry i thought u meant $56000, if not i cant sell the car” I thought ok, since you heard wrongly i will give you the benefit of the doubt. I ask my girlfriend to pass him the the $1500 cash as deposit. But state on the sales agreement that if loan is disapproved full sum will be refunded. When my girlfriend took the sales agreement from him, we were surprised that he had used another company name to close the sales instead of the one advertised. He was using Ktrust Automobile, but similar address. I did not pay attention as the address was similar.
Following the few days prior to collection of car, we had sms exchanges regarding loan applications and he told me my loan for $56000 was only approved at $49000 max. I told him i needed a $53000 loan at least and he told me he will loan me personally $4000 at a 0% interest. Payment will be made over 10 months at $400 per mth starting from Feb. I was still hesitant if i should pay the downpayment in full, but i was lucky i accepted the “personal loan”, if not i will be $4000 poorer.
14th January
On the 14th of jan, he told me my loan was approved with Maybank and he will send the car over to my house. At my place, i signed the loan agreement and LTA transfer form. We then went to the atm which i withdraw balance payment of $5838.08 to pay him. The balance payment is inclusive of 1st mth instalment to Maybank, Insurance from chartis, Agreement fee from Freddie Khng, LTA Transfer Fee & balance downpayment.
20th January
This is the beginning of the nightmare. On the 1st few days, i drove around and found that there was smoke coming out of the bonnet. I smsed Freddie and he says its ok, just go for a service and he will pay for it. I had not time to send for a service. On 20th jan, my girlfriend took some time to drive it down for service, but halfway down, the car stalled and couldnt get it started again. It was towed to my frequent workshop. We realised that the radiator had burst and the engine was overheated. Freddie reassured that the car was in prefect condition when being sold. Over the next few days as the mechanics check the car, i was quoted repair cost to be around $2-3000. I ask the mechanic to talk to Freddie, which in turn shocked me with what he said. “just repair so long the car can move, the rest dont care” I was seriously pissed with what he said but in the end, he promised to pay $800 for the repair fee. Which was to be deducted from the $4000 personal loan. And during the repair, i realised that the car had previously been repaired before. Which i believe was repaired prior to sale.
25th January
He smsed me in the morning asking me if i can make $1000 payment for personal loan. I transferred $1000 to him as payment.
29th January
The car was ready for collection after a week of repair.
10th Feb
Freddie called me up with a suggestion. He told me that his company couldnt settle the car outstanding loan and ask me to carry on instalment for the car, paying him $681 for a year before he take up a loan again for me and transfer the ownership to my name. I was very angry and felt cheated that i had paid so much for the car, in the end only to be carrying on instalment for a car not under my name.
11th Feb
Called up maybank and was told that no loan was taken for the car under my name. Called Freddie and he insisted that the loan was approved, just that it had not been proceeded.
12th Feb
Met up with him at my place with a friend and he tried to negotiate with be regarding the refund. Saying that i cancel the agreement i will have to pay a sum of money. The agreement was never to carry on instalment. We came to an agreement on $7300 and he kept saying that he had to pay me by instalment as he had no money. Kept asking me for the repair receipt even though i said i will bear the cost of it. Says he wants to show it to the ex owner. I was thinking he surely wanted to claim from the ex owner. I would not return him the car as yet as i thought he would ignore me after i had returned him the car. I told him that the engine mounting is not in good condition and the car was trembling and he told me to help him fix, even temporary so that when the next person who viewed would not realise during the test drive.
16th Feb
Called up Chartis to cancel the insurance policy, only to find out i have been overcharged by over $300. I was quoted $2300+ when the actual amount was $2002. I immediately called sms Freddie about the difference and he called me to say he may have overlooked and accidentally charged more.
17th Feb
I felt that i could no longer negotiate with him and got a lawyer to claim compensation.
24th Feb
Received information from my lawyer that he had also engaged a lawyer. Now waiting for further instructions from my lawyer regarding the compensation.
Please exercise caution when dealing with this 2 company.
